Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using Massage For You ("Platform," "Site," "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and DKVISION LLC. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those changes.

2. Platform Description & Disclaimer

Clients contact therapists directly at their own discretion and assume all associated risks.

No implied license. The fact that a photo, name, likeness, or piece of personal information is publicly accessible elsewhere on the internet does NOT grant Massage For You, DKVISION LLC, any user, or any third party the right to reuse it. All content must be submitted by someone who holds the necessary rights, permissions, and consents (see Section 4A).

3. Profile Creation & Administration

Therapist profiles on the Platform may be:

• Submitted and managed directly by therapists through self-registration
• Created or edited by Platform administrators using publicly available information for directory purposes

The Platform does not guarantee the accuracy, completeness, or currency of any profile information. Therapists may request edits, updates, or removal of their profiles at any time by contacting support@massage-for-you.com.

"Verified by Admin" designation means only that the profile content has been reviewed for compliance with Platform rules. It does NOT indicate verification of professional credentials, background checks, or endorsement of services.

4. User Roles & Responsibilities

4A. User-Submitted Content — Ownership, Warranties & License

"User Content" means every photograph, image, portrait, likeness, video, logo, business name, trade name, biography, headline, description, review, message, address, phone number, and any other text, image, data, personal information, or other material you upload, submit, post, publish, or otherwise make available to the Platform — whether submitted during account registration, profile creation, profile editing, reviews, support messages, or any other feature.

Your representations & warranties.

By submitting any User Content to the Platform, you represent and warrant to DKVISION LLC that:

• You own the User Content or you hold every license, right, permission, release, and consent necessary to submit it and have it published on the Platform in the manner contemplated by these Terms;
• You have obtained the explicit, verifiable consent of every identifiable person depicted or referenced in the User Content (including every person appearing in a photograph) to appear on the Platform in connection with your listing;
• Your User Content does not and will not infringe, misappropriate, or violate any third party's intellectual-property right, right of publicity, right of privacy, likeness right, moral right, contractual right, personal-information right, or any other legal or equitable right;
• Your User Content complies with all applicable laws, regulations, and these Terms, including the Rules & Content Policy;
• Any personal information in your User Content (including phone numbers, email addresses, physical addresses, photos of other people, or any other personal data) was collected and is being shared in compliance with every applicable privacy or data-protection law and with the written consent of every data subject;
• You have not and will not submit User Content that was taken, copied, scraped, downloaded, or otherwise obtained from any third party, website, social-media account, or other source without the express permission of the rights holder.

License grant to Massage For You.

By submitting User Content to the Platform, you grant DKVISION LLC and Massage For You a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, modify (for formatting, resizing, compression, watermarking, moderation, and similar operational purposes), create derivative works of, display, perform, publish, and distribute that User Content, in whole or in part, through the Platform and any successor or related services, and in connection with operating, maintaining, moderating, improving, marketing, and promoting the Platform (including search-engine indexing, social-media previews, email, and advertising). This license continues for as long as the User Content remains on the Platform and for a reasonable commercial period afterwards to permit backups, archives, and compliance with legal obligations.

You retain ownership of your underlying rights in your User Content, subject to this license. This license does not transfer ownership of your User Content to DKVISION LLC.

Platform does not pre-screen or verify.

DKVISION LLC does not pre-screen, pre-verify, independently check, or confirm the ownership, legality, authorization, or accuracy of User Content before it is published. Admin review of a profile for Platform-rules compliance is not verification of a user's rights in the content and is not an endorsement of the content, the therapist, or the services advertised.

5. Subscription & Payment Terms

Therapists pay a recurring monthly subscription fee to publish their profile on the Platform.

• Billing: Subscriptions are billed monthly on a recurring basis
• Automatic Renewal: Your subscription automatically renews each billing cycle until canceled
• Payment Processing: All payments are securely processed by Stripe. DKVISION LLC does not store credit card data

6. Platform Rights & Content Moderation

DKVISION LLC reserves the right, at any time and without prior notice, to:

• Edit, modify, unpublish, suspend, or permanently delete ANY profile or listing
• Remove, modify, or disable photos, text, links, personal information, or any other content
• Approve, reject, or modify submitted content
• Act on any legal, copyright, trademark, privacy, publicity, likeness, defamation, personal-information, ownership, or similar complaint — including by promptly removing or disabling the content, suspending the account, and preserving relevant data for legal process
• Terminate any user account for any reason or no reason
• Modify, suspend, or discontinue any aspect of the Platform

No explanation is required for any content moderation decision. All moderation decisions are final.

7. Prohibited Content & Conduct

The following are strictly prohibited on the Platform:

• Sexual, erotic, or adult services of any kind
• Escorting, companionship, or fetish services
• Sexualized language, imagery, or nudity
• Illegal services or activities
• Misleading, false, or fraudulent information
• Stolen, unauthorized, or copyrighted content
• Harassment, discrimination, or abusive content

Violations result in immediate profile removal and account termination without refund.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DKVISION LLC, Massage For You, and their respective owners, members, managers, officers, directors, employees, agents, contractors, licensors, and affiliates SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, revenue, data, goodwill, or business opportunity) arising out of or related to your access to or use of the Platform, any User Content, or any interaction with another user, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not DKVISION LLC has been advised of the possibility of such damages.

To the extent any liability of DKVISION LLC cannot be excluded under applicable law, our aggregate liability to you for all claims arising out of or related to the Platform shall not exceed the greater of (a) the total subscription fees you paid to DKVISION LLC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

USERS ACCESS AND USE THE PLATFORM ENTIRELY AT THEIR OWN RISK.

9. Indemnification

You agree to indemnify, defend, and hold harmless DKVISION LLC, Massage For You, and each of their respective owners, members, managers, officers, directors, employees, agents, contractors, licensors, successors, and affiliates (the "Indemnified Parties") from and against any and all third-party claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and court costs) arising from, related to, or in connection with:

• Any User Content you submit, post, or publish on the Platform (including any photograph, image, likeness, name, text, address, phone number, or other personal information);
• Any actual or alleged infringement, misappropriation, or violation of a third party's copyright, trademark, trade dress, right of publicity, right of privacy, likeness right, moral right, personal-information right, data-protection right, defamation claim, contractual right, or any other intellectual-property or proprietary right;
• Any actual or alleged failure to obtain the required rights, permissions, consents, model releases, or authorizations for any User Content;
• Any actual or alleged violation of a privacy, publicity, data-protection, biometric, or personal-information law or regulation;
• Your use of the Platform;
• Your violation of these Terms or the Rules & Content Policy;
• Your violation of any applicable law or regulation;
• Your profile content, services, pricing claims, representations, or conduct;
• Any dispute between you and another user, including any client, therapist, or third party contacted through or because of the Platform.

The Indemnified Parties reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with the Indemnified Parties' defense of such claim.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. DKVISION LLC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

DKVISION LLC MAKES NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, OWNERSHIP, LEGALITY, OR AUTHORIZATION OF ANY THIRD-PARTY OR USER-SUBMITTED CONTENT APPEARING ON THE PLATFORM, AND DOES NOT ENDORSE ANY INDIVIDUAL THERAPIST, LISTING, SERVICE, OR CLAIM.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida. You consent to personal jurisdiction in these courts and waive any objection based on venue or inconvenient forum.

12. Dispute Resolution

Before initiating any legal action, you agree to first contact DKVISION LLC at support@massage-for-you.com to attempt informal resolution of any dispute.

You agree that any claims against DKVISION LLC must be brought individually and not as part of any class action or representative proceeding.

12A. Copyright, Privacy & Ownership Complaints

If you believe any content on the Platform infringes your copyright, trademark, right of publicity, right of privacy, likeness right, or personal-information right, or was published without the authorization of someone with authority to grant it, please send a written notice to:

To help us act fast, please include:

• Your full legal name and contact details (and, if you are a representative, the person or company you represent);
• A clear description of the content you are complaining about and the exact URL(s) on the Platform where it appears;
• A clear description of the right you believe is being infringed or violated (e.g., copyright, privacy, likeness, personal information);
• A statement that you have a good-faith belief that the content is not authorized by the rights holder, that person's agent, or the law;
• Proof of your rights or identity where applicable (e.g., link to the original source you own, government ID of the person depicted, or an authorized representative letter);
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorized to act on the rights holder's behalf;
• Your physical or electronic signature.

DKVISION LLC will review each valid complaint and, where appropriate, remove or disable the content, suspend the responsible account, and preserve relevant records for legal process. DKVISION LLC may also require additional documentation to verify your rights or identity before acting.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and Rules & Content Policy, constitute the entire agreement between you and DKVISION LLC regarding your use of the Platform.

15. Modifications to Terms

DKVISION LLC reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Platform after any changes constitutes acceptance of the modified Terms.
